I have an employee who is being selected by the DOT random consortium, which uses a computerized selection process, every so often - three times in the last 5 quarters.  He always tests negative.  His name came up again as a random selection.  Should he still be tested or should/can the employer select the next employee in the random pool?  The employee obviously is not too happy with his frequent selections. Thanks.
