Will add another twist that might be part of the question that was raised. Initial breath alcohol testing done within a few minutes of placing any alcohol containing substance in the mouth will screen as positive BUT that is one of the reasons a 15 minute confirmation test is required to report as a confirmed positive. That scenario wouldn't confirm (unless enough had been actually ingested to get the positive level found in the blood). And of course agree that source matters not if level is intoxicating.
