I agree with you - your logic fits the regs which were tightened for the SAP's a couple of years ago: 40.163(g)You [MRO] must not provide quantitative values to the DER or C/TPA for drug or validity test results. However, you must provide the test information in your possession to a SAP who consults with you. AND 40.293(f) For purposes of your [SAP] role in the evaluation process, you must assume that a verified positive test result has conclusively established that the employee committed a DOT drug and alcohol regulation violation. But it might be educating to discuss for what purpose the levels are to be used.
