Good points and I appreciate your opinions/thoughts. Like I said - I'm not looking for loopholes. Just a concerned and confused family member who is trying her best to understand. It seems to me that even though it may well have been allowable within legal parameters, the case manager's e-mail was overzealous and unnecessary. The patient was not a practicing physician - had not been for 4 months. In TX, reports of impaired physicians are made to the State Board of Medical Examiners. The rehab program did not do that. There was no danger to public safety. There was no danger to anyone. The rehab program stated to patients in group and individual sessions that the only way they would notify authorities was if someone's life was in danger. Not the case here. The case manager actually apologized to me - said he did what he thought was best and that he felt he had a responsibility to report the confession. Said he was hoping the probation officer would "forget about it." I found out later that my brother was this case manager's first patient at this rehab program. The lawyer has stated it was wrong of the rehab program to do but is not using it as a premise for any kind of defense and will not discuss it further. Anyway - Guess we'll just have to move on from here and see what happens. Thanks for your input
