40.67(l) does not explain this fully, but in the urine collection handbook 1.01 under the section on observed urine collection; it states 7. If the employee declines to allow a directly observed collection required or permitted by Part 40 to occur, the collector discards any specimen the employee provided previously and notifies the DER as soon as possible. This is considered a refusal to test. So I would not report the specimen as cold and negative. This specimen should not have been sent to the lab in the first place. I would cancel that result and report a refusal to test.
