The DOT Part 40 rule requires the MRO to tell the DER what drug(s)/metabolite(s) the donor tested positive for. If the donor challenges the test result in court, the entire record becomes available to the plaintiff and defendant lawyers through discovery, and they will present part or all of the record to the judge as evidence in any courtroom proceedings.
