Medical marijuana

Hi, I am a MRO in Colorado and i have a question about medical marijuana.

I have a driver who had an accident in his 18 wheeler.  Fortunately no damage to him or the vehicle.  He had a positive urine drug screen for marijuana which was >1000 ng/mL.  I called him and he has a valid medical marijuana card from a doctor in Denver.  He tells me he uses it for pain about 3-5 times per month.  He boils it and then drinks it as a tea.  He says he last drank the tea about two days before the accident.  He weighs about 240 lbs.  He insists that he doesn't drink his tea right before getting in his 18 wheeler.  My question is, should I report this as "negative" and then if I do should I request that the employer take him out of a safety sensitive job?  Colorado just passed a bill that says it is not illegal to possess small amounts of marijuana.  Does that affect any decision-making?
