We wish to hire a person for our hospital based occupational health clinic who shall be in a multi-task role. One of the functions of this person shall be to serve as observer for direct observation of male collections. Because it will be necessary to observe male collections, and since only same sex observers are permitted by Federal Regulation we must, in some way, specify that the person for this position must be a male. Human Resourses states that we must be very careful about posting a position in which we specify that male sex is required for this position. The dilema: We are not permitted to specify that a male is needed for this position. Federal regulations require that only a male can perform this essential job function. Have others had this problem and how did they solve it?
