Every MRO has their own ways and methods for non-DOT tests. In general most MRO’s like to follow DOT protocol, and we like to make sure that the spirit of the regulations are always followed. In non-DOT tests we do make some minor exceptions and changes and sometimes do things a bit differently as you mentioned. Sometimes the company helps us and tells us what they would like. And sometimes we help the company for certain things like you mentioned. For example, generally in non-DOT tests, I merely report the results of the non-negative test to the employer. Our time frame for no contact positives also vary from company to company as well. Some companies ask us to report the no contact results after 3 attempts over 3 days. Other can be a bit different. We have never had any legal problems with minor things of this nature. Most legal challenges are about the results (positive for cocaine, positive for marijuana, etc.) and not minor reporting variations like you described.
