Is the TPA responsible for the employer's noncompliance?

The scenario:  A third party administrator (TPA) that performs random selections discovers its client omits key personnel who must undergo testing from its roster of covered employees submitted to the TPA.  Previously, the TPA did not know these employees worked for the company.  Any advice?
