I'll tackle question #1:   Different drug test panels for different jobs is perfectly fine and legal if consistently applied.  And it makes good sense.  It is of course discrimination just as choosing whom to hire or fire is discrimination (also defined as a "decision").  You just shouldn't and can't discriminate on the basis of race, sex, national origin, religion, age, or handicap unless precluded by a bona fide job requirement.  Even the Americans with Disabilities Act (which doesn't apply to drug screening per se) recognizes different medical exams for different jobs.
