Further clarification: A breath alcohol test was performed using a Phoenix Portable Breath Tester manufactured by Lifeloc Technologies. An appropriate air blank test was conducted followed by the screening test, which was positive. This was appropriately followed after the 15 minute waiting period (15-30 minutes later) by another air blank test and a confirmation test which corresponded to the screening result. Some hours later as a quality assurance measure, a verification (“calibration check”) was to be performed. A dry gas “calibration check” was the intent, but instead the technician performed a dry gas calibration instead of the dry gas “calibration check”. A calibration is the test that is generally performed annually as a quality assurance by DOT regulations or whenever two “calibration checks” fail in succession. So a calibration was done. This was than followed by a “calibration check” which was good.

Does the fact that a dry gas calibration (or wet bath calibration) was performed before the “calibration check” alter the verification process? Does it cancel this test? Please advise
