Dr Steve is of course correct - 49 CFR §40.65(b)7 - the specimen is discarded and the DER is notified of a refusal to test (refusal to complete the collection event and cooperate with collection personnel, which in this case required two samples). The regulations are I believe unclear as to (1) what to do with the CCF(s) but certainly a notation should be retained as to the events (and the CCF is a good place), and (2) the MRO may not be needed to be involved is such a case, but might be a good repository of the record. Worthy of mention here is a side-related caveat: A shy bladder begun and eventually a cold specimen given, observed collection begun and again a shy-bladder begun - but not from the initial time! the clock resets to zero, up to 3 more hours to go!
