Please help me out, here. The post says, "Now that the 8th Circuit has ruled...," implying that there is a recent decision that needs to be considered. As far as I'm aware, the 8th Circuit has not had any significant rulings on sweat testing for at least 4 yrs, but I could be wrong. Which ruling are you referring to? Can you identify it by name, case number, date, or some other identifier?
It should be noted that workplace sweat testing is a concept and not a reality. There are no employers who conduct sweat tests of their employees. I feel it's important to point this out since most of the postings on this discussion board address workplace testing.
