Non DOT UDS on a DOT driver

I have a DOT driver who was in an accident while performing his DOT duties. The employer asked for a non-DOT UDS. A DOT test was done instead by the tech. The employer states that "if the driver didn't get a ticket, or if there was no death involved, or the vehicle was not towed, a DOT test is not required." This does not sound right, kindly advise on the particular reference/ CFR pertaining to this situation. Thanks.
