1. A TPA (third party administrator) is a service agent (vendor) that provides or coordinates the provision of a variety of drug and alcohol testing services for employers. This may include policy review, educational materials, training programs, random sampling of employees, collections, laboratory, and/or MRO services. The owner-operator is required to be part of a TPA for purposes of random drug test selections. You, the MRO, could ask the employer if it is part of a TPA for random selections. If the employer is not, then you can help educate the employer on this point.
2. You do not need to notify California DMV of the driver's positive test result. There are now six states that have, or are about to have, centralized state registries of drug test violations. California is not among these. The six states are: Arkansas, New Mexico, North Carolina, Oregon, Texas, and Washington.
3. The driver's California CDL is not revoked due to a DOT drug test violation.
4. There are no MRO responsibilities here beyond reporting the result to the employer.
