Obviously we are talking about non-regulated testing, since the DOT does not allow for “Medical THC”. I work and live in California, where it has been shown by several news agencies, that if you have enough money, you can and will find a physician who will write you a “Medical THC” recommendation. Many advertise that your visit is free if you do not come away with this recommendation! On then other hand, there are individuals who probably benefit from “Medical THC”.

Every MRO has their own way for verifying these types of results. Some MROs strictly follow federal guidelines, report the results to the company as positive, and then allow the company to deal with this issue on their own. I know other companies who have a policy that allows Medical THC, and ask the MRO to report the results out as a negative test, period. Other companies have similar policies that allow “Medical THC” might ask their MRO to report the test out as a negative with a requirement of a safety concern letter from the donor’s treating physician. So you as the MRO, will have to develop your own policy and some of this might be dictated by the company. However in every case (unless you strictly follow federal guidelines for all tests and reporting), you should make sure the individual lives and works in a state that allows “Medical THC”, has a letter from the treating physician (that you verify) authorizing the use of “Medical THC”, that this letter is current (i.e. done before the test, and has not expired), and lastly that the company has a written policy (you would want a copy) when it comes to “Medical THC”. If the company does not have any policy, then report it out as a positive, and let the donor discuss this issue with the company.
