Remember that a dilute sample can be provided for totally innocent reasons. Some people do drink a lot of fluids and much more rarely there may be some who have kidney problems that affect the ability to concentrate the urine. Rather than making accusations that probably could not be supported, perhaps follow the Part 40 option of recollecting the sample with minimal notice. If the creatinine is between 2 and 5 it certainly raises more suspicion and the Part 40 guideline of recollecting under direct observation should be considered. I hedge here only in that if you are doing non-DOT tests you need to be sure your state allows directly observed collections. The criminal justice system may well have other rules to follow. I agree with Dr. Swotinsky's post that if you are obligated to do onsite tests rather than the preferred lab-based testing you should include some onsite validity testing.
