If a DOT CCF is used, is the test under federal authority?

This company has been using the federal CCF for over 15 years and has since been told to use non-DOT forms by a drug and compliance manager in DC.  There is currently a problem determining if their employees are under DOT regulations concerning the previous testing procedures.  One of them is now in litigation.  Do you know the answer?
