In the Urine Specimen Collection Guidelines published by the United States Department of Transportation, it states:

SECTION 5. EMPLOYEE IDENTIFICATION - The employee must provide appropriate identification to the collector upon arrival at the collection site. Acceptable forms of identification include:

1. A photo identification (e.g., drivers license, employee badge issued by the employer, or any other picture identification issued by a Federal, state, or local government agency), ...

It does not specifically state that the driver's license must be current. If all you are trying to do is to identify the donor to make sure that the donor is actually who he/she says they are, I do not see a problem with a recently expired drivers license, as long as the picture and the donor match. If the individual is applying for a DOT position that requires that he/she has a current driver's license, that might pose a different type of problem. However for the simple purpose of identification, a picture ID from a drivers license (hopefully not too long expired) that clearly has their picture, would probably be acceptable to me.
