The donor may allege a violation of HIPAA. I suspect that HIPAA does not apply to drug tests performed as part of court-ordered monitoring. Instead, HIPAA applies to certain personal health information.
The donor may want to sue. But, the donor's attorneys would need to establish damages that they're seeking to recover. It's unclear given the available information if there have been, or will be, any damages to the donor from posting of this photo on the web.
