Reporting results from paired collections; changing reports

Two questions:

1. A company is questioning our policy of reporting multiple collections. If one (cold specimen) is reported neg and the observed is positive, we report only the positive result. This proposed rule is found in 49 CFR part 40.162. Is this recommendation cited anywhere else? It is not in the current regs. They are requesting sources on this practice.

2. We cancelled a DOT test after not receiving the MRO ccf after multiple requests. The TPA sent us several MRO ccfs today from 2006 collections wanting us to review the results now. Is there any time frame to address this issue?
