I referred a commercial driver (DOT) to a Substance Abuse Professional (SAP) as part of a return to work fitness for duty assessment. The driver sustained a MVA while at work, was hospitalized for several days for delirium tremens but unfortunately due to delays, there was no documented positive BAL at the time of the accident. The SAP is wondering if they can mandate random BAL as part of the RTW program. To me it seems like a good idea in this case, especially as there is a past history a few years back of DUI (non-work-related). Will the absence of a positive alcohol test be a problem in this case? Thanks.
