A very similar example of this came up last week here, at my office. The RTW evaluation and recommendations are essentially acting outside of the MRO/SAP world, and outside of any regulations stated in Part 40. As far as Dr. Swotinsky and myself, we believe the evaluator (perhaps someone who has S.A.P. credentials but not acting here as a S.A.P.) can make this evaluation and determination, and can have certain stipulations as part of this individual’s RTW process. I see no problem with that. But this process is acting outside of the MRO/SAP world, so to speak, since there were no formal, DOT-regulated test results where actions must be taken.
