I got a call from some official in our State probation system one time asking me a question about a test result. (Not one that I MRO'd.) I asked him who his MRO was. They don't use one--just call the lab or whoever, I guess, to try to get an answer. I asked the "what if" question about the individual maybe having a prescription to clear the test. The response was, "he can tell it to the judge." I asked why they would waste the time and money of a court hearing if it was just a prescription (that a MRO could clear off for the whopping fee of $5-10). Again the response was that the guy could tell it to the judge. Most judges know the law very well, but don't (and I would not expect them to) understand the nuances of drug testing and forensic toxicology. I'd bet they would prefer to have the best information available to them when they have to make their decisions. With as busy as our courts are and the consequences for the individual of having a drug test misinterpreted (days in jail, years in prison??) I just do not understand why the system cannot do better.
