Donor requesting additional reconfirmation

I reviewed a non-regulated test that was collected for cause. The test was positive for fentanyl, and on the MRO interview, the donor provided no medical explanation. The result was reported as positive, and the donor elected to have the split sent for reconfirmation.
The split sample reconfirmed for fentanyl.

The donor is now represented and the attorney is requesting further analysis of the specimen at a lab of their choice.

How to proceed? Does the donor have any rights to additional testing of the split sample at a different lab? Does the donor have any right to request an aliquot of the original A sample to be sent to a different lab?

Or will the attorney have to work with either of the labs directly?

Generally, donors do not have an option for multiple reconfirmation analyses.

The attorney can seek additional testing and, if he/she is granted that right by the courts or by the employer, the attorney or you can contact the laboratory directly to arrange it.

I understand the distinction between having a split tested at the same lab v. a different lab. But, there is no requirement for a different lab in a nonregulated test. And, while the use of a separate lab may provide a perception of independence, the technicians at the "same" lab perform these tests in a relatively blinded fashion and thus are not biased in favor of a positive reconfirmation.
