CBD products and DOT exam

I am confilcted when presented with the driver who is taking CBD products. I understand the exam is a Federal one and that DOT does not allow CBD products to be used to overturn positive test results, but the 2018 Farm Bill it took CBD and other hemp derivatives out of the Controlled Substances Act and put them under the FDA who is trying to get their arms around the issue. My current thought is to do a POCT with the physical and if positive, not pass them. I also strongly advise them from using the products but would like to hear others thoughts about how to manage.

If a driver reports the use of CBD, I would not pursue this further with regard to the potential that the CBD has up to 0.3% THC content. Yes, the use of THC is a disqualifier. But, the use of CBD is not.

In my practice, I have often sought drug testing as part of the DOT physical when I suspect something is amiss and I want the test to help clarify. I've also found that others (clinical support staff, administrative staff, patients) are resistant to adding a drug test to the exam for multiple reasons. My point is, I do advocate for testing where appropriate.

But in the case of a DOT physical where the donor has disclosed his/her use of CBD, and there's not evidence that the use of CBD products puts drivers at risk of crashes nor is CBD identified by regulation as a disqualifier, I think ordering a drug test would be looking to create a problem that doesn't need to be there.
